These Terms of Use outline the responsibilities of both ShiftNest and its users. By accessing or using ShiftNest, you agree to comply with these terms and all applicable laws.

1. Acceptance of Terms

By creating an account or using ShiftNest, you confirm that:

  • You are authorised to act on behalf of your organisation (if applicable).

  • The information you provide during registration is accurate and complete.

  • You agree to use ShiftNest in accordance with these terms, applicable regulations, and data protection laws.

2. Platform Access and Accounts

  • Users are responsible for maintaining the security of their login credentials.

  • ShiftNest is designed for professional use by agencies, facilities, and shift workers.

  • You must not share access credentials or use another person’s account.

  • ShiftNest reserves the right to suspend or terminate accounts in cases of misuse, unauthorised access, or violation of the platform’s policies.

3. Billing and Payments

  • Agencies are solely responsible for billing and payments.

  • ShiftNest charges a 2% usage fee based on signed timesheet values.

  • Payments are securely processed through Stripe, a PCI DSS–compliant payment processor.

  • No fees are charged to facilities or shift workers.

4. Cancellations, Disputes, and Refunds

  • ShiftNest provides the tools for shift creation, approval, and digital timesheet management.

  • Any cancellations, payment disputes, or refund arrangements between agencies and facilities are to be resolved directly between those parties.

  • ShiftNest is not liable for disputes arising from third-party agreements, staffing issues, or incorrect submissions.

5. Data Protection and Security

  • ShiftNest complies with UK GDPR and Data Protection Act 2018 requirements.

  • All data is encrypted and stored securely in UK/EU data centres.

  • ShiftNest is Cyber Security Certified, ensuring compliance with modern security standards.

6. System Availability

We strive to provide uninterrupted access to the platform. However, temporary downtime may occur due to maintenance, updates, or technical issues. ShiftNest will always act promptly to restore access and minimise disruption.

7. Limitation of Liability

ShiftNest provides the platform “as is.” While we maintain rigorous security and uptime measures, we are not liable for indirect losses, data errors, or downtime caused by external factors or user misuse.

8. Updates to Terms

We may update these Terms of Use periodically to reflect product changes, compliance updates, or legal requirements. When this happens, a notice will be posted on your dashboard or sent via email.
